Terms of Sale & Website Policies
1. Authority to Contract
QS Capital LLC reserves the exclusive right to determine whether a prospective Buyer may enter into a Standard Agreement of Sale, Land Contract, Contract for Deed, or any other financing arrangement. All agreements are subject to applicable laws and are void where prohibited. In the event of pricing discrepancies, pricing published on the official QS Capital LLC website shall control over any third-party advertisements or listing platforms.
2. Property Condition & Sale Status
All properties are sold strictly in “AS-IS” and “WHERE-IS” condition, with all known and unknown faults. Buyer acknowledges that properties may be subject to:
- Recorded or unrecorded easements
- Covenants and restrictions
- Rights-of-way Mineral or exploration rights
- Zoning classifications
- AssessmentsLand use limitations
All sales are final. QS Capital LLC does not provide guarantees regarding the physical condition, future usability, or development potential of any property. It is the Buyer’s sole responsibility to conduct all due diligence prior to purchase.
3. Buyer Due Diligence Responsibility
Buyer is solely responsible for independently verifying :
- Property boundaries
- Legal and physical access
- Zoning and land use regulations
- Utility availability
- Water availability
- Septic requirements
- HOA obligations (if any)
- Tax assessments
- Permit requirements
Failure to investigate or inspect the property does not provide grounds for cancellation, refund, or legal claim against Seller.
4. Property Use Restrictions
Unless the property has been paid in full and the deed has been officially transferred and recorded:
- No permanent residence is permitted.
- No construction or improvements requiring permits are allowed.
- No building permits may be obtained.
Buyer agrees to comply with all applicable local, county, and state laws.
If Buyer violates any ordinance, code, or regulation related to the property – including unauthorized occupancy – Seller may cancel the agreement and retain all monies paid as liquidated damages.
Recreational use may be permitted only if allowed by the governing county and Buyer’s account remains in good standing. Buyer must verify allowable activities directly with local authorities.
5. Reservation & Deposit Policy
Properties are sold on a first-come, first-served basis and cannot be reserved without payment.
If Buyer submits a down payment but later decides not to proceed:
- All deposits are non-refundable.
- Document preparation fees are non-refundable.
- Processing fees are non-refundable.
- Installment payments already made are non-refundable.
The required purchase agreement must be signed within seven (7) days of payment submission. Failure to complete documentation may result in cancellation and forfeiture of fees.
6. Owner Financing Terms (If Offered)
QS Capital LLC may, at its discretion, offer Seller Financing.
Typical features may include:
- No credit check requirement
- Fixed monthly installments
- Low down payment
- No prepayment penalties
- Deed transfer upon full payoff
Under a Contract for Deed or Land Contract:
- Seller retains legal title until the balance is paid in full.
- Buyer obtains equitable interest only.
Payment Terms
Payments are applied in the following order:
- Fees
- Accrued interest
- Principal
Late Charges
- 10% of the monthly payment or $10 minimum (whichever is greater) after 14 days late.
- $25 returned payment fee for bank rejections.
If payments are ninety (90) days delinquent, Seller may terminate the agreement without further notice and retain all prior payments as damages.
A monthly servicing fee of $15 will be added to financed accounts.
There is no penalty for early payoff.
The deed will be delivered within forty-five (45) days of final payment.
Electronic signatures are valid and enforceable.
7. Property Access Disclosure
Many properties sold by QS Capital LLC are located in rural or undeveloped areas.
QS Capital LLC does not guarantee:
- Legal access
- Recorded easements
- County-maintained roads
- Permanent road access
Access information may be based on:
- Public GIS systems
- Satellite imagery
- Historical records
- Third-party mapping services
Such sources are informational only and are not legally determinative.
Buyer accepts full responsibility for verifying access rights and understands that establishing legal access may require additional expense, negotiation, or legal action.
8. No Guarantees or Warranties
QS Capital LLC does not warrant or guarantee:
- Accuracy of property boundaries
- Buildability
- Water rights
- Utility availability
- Septic approval
- Mineral rights conveyance
- HOA status or fees
- Zoning compliance
- Future development potential
- Road conditions
All information provided online or in marketing materials is believed to be accurate but is not guaranteed.
Only the representations contained in the executed purchase agreement and recorded deed shall be legally binding.
9. Taxes & Assessments
Buyer is responsible for:
- All property taxes assessed after the date of sale
- All property taxes assessed after the date of sale
- Special district assessments
If Seller financing is used, taxes and fees may be incorporated into monthly payments.
Buyer must confirm tax obligations directly with the appropriate county offices.
10. Buildability & Permits
Seller makes no representation that any property:
- Is suitable for construction
- Qualifies for building permits
- Meets septic or soil requirements
- Can obtain utility connections
Buyer must verify development requirements with local planning and zoning departments prior to purchase.
11. Website & Information Disclaimer
Property descriptions, images, maps, measurements, and pricing displayed on the QS Capital LLC website are provided for informational purposes only and may change without notice.
QS Capital LLC is not liable for:
- Typographical errors
- Mapping inaccuracies
- Omitted details
- Third-party misinformation
Independent verification through public records is strongly encouraged.
12. Governing Documents
These Terms apply to:
- All website listings
- Marketing materials
- Payment submissions
- Executed agreements
If any inconsistency arises, the signed purchase agreement shall control.
